[TW] TW Caps apply to Earthlink resold service?

TW has announced caps coming in the Austin area. Does anyone know if this will also apply to the Earthlink service that rides on TW or do they get to keep their own terms? Could I just switch to Earthlink and not have to worry about caps.

I spoke with an Earthlink rep online today. I told him I read about TW emposing caps in my area, Greensboro, NC. He said they didn't have any caps and weren't planning on implementing them.

Just one rep but who knows.

I just switched to Earthlink in Durham. Greensboro is close enough to be scared the caps are coming up 85 soon.

Considering TWC's network was opened up to Earthlink to increase competition, I hope they do not implement caps. At least I'll save $20 for 6 months and $8 after that. TWC really stuck it to me as a non-cable customer.

Earthlink is just using Time Warner lines and you believe that EL might not have to get onboard?
TW would eventually have no customers as Earthlink would have them all with no infrastructure or investment in infrastructure.

Yes, but anything to delay the inevitable. If I have no other choice I would rather go to Earthlink even if they have the same caps as TW. At least they aren't responsible for the caps and hopefully TW would get less of my money that way. If everyone did the same TW would be in the same boat.

It's taken 9 years but how this all plays out will finally clarify what was accomplished by opening up TWC's network to Earthlink. If all they do is fall in line with TWC with every decision, what was the point? The services have different prices, and caps are really just elaborate billing schemes, so I'm hopeful that Earthlink will remain autonomous on this issue.

All that exists today is an AGREEMENT between Time Warner and EarthLink. Their ORIGINAL relationship was an outgrowth of the TW/AOL merger, when government regulators sought to protect ISP competitors such as EL. However the US Supreme Court overturned a federal court decision that would force cable companies to share their infrastructure with Internet service providers such as Brand X and EarthLink.

Time Warner likes the deal with Earthlink because they have a reseller who also writes a fat check to them without some other expenses, such as marketing.
Basically Time Warner will simply tell Earthlink what will be required if they wish to renew the agreement, and Earthlink will be fine with it.

All billing is handled by TWC so Earthlink usage will be metered as well. Verizon will meter soon enough, although they might want to see if they can get TWC to go bankrupt first. There is no place to hide when all ISPs want to make money off of content and the government is owned by whoever makes the money.

It would seem that Earthlink already has the ability to comply with TW caps without additional notification. Refer to Section 4, para 4 of the Earthlink Internet Service Agreement. It states "The Cable Provider may limit the amount of data that you can upload and/or download each month." This seems to allow TW to place caps but not charge additional usage fees. To Earthlink users_yet.
