Norweigan Court: No need to block Pirate's Bay

Finally! A court with some common sense.

The IFPI has lost its case against Telenor, Norway's largest ISP, regarding forcing it to block users' access to The Pirate Bay.

"The court ruled that Telenor is not contributing to any infringements of copyright law when its subscribers use The Pirate Bay, and therefore there is no legal basis for forcing the ISP to block access to the site."

The Norweigan District Court also stated that blocking access to certain websites is usually the responsibility of authorities and that giving this task to private companies would be "unnatural".

Obviously the **AA didn't or couldn't come up with enough bribe arguments to influence the court.

You don't need bribes these days. Legal systems are so tangled up in bureaucracy and are so understaffed these days, that the advantage goes to keeping things as they are. (They've got the head of the Peanut Corp. of America sending emails saying "turn them loose" and people died. Any jail time? Not yet. I've had two Attorney General's offices in the past year explain their lack of progress in investigations with the explanation "lack of staffing".)

The Norwegian court ruling merely stated enforcement regarding copyright violations should be the burden of the authorities NOT of ISPs or private companies. That seems obvious enough, but then again Norway probably doesn't have much to lose in the way of business. In the US, you'd be likely to hear the argument that the record/motion picture/software industries are "just too big for us to let them fail".

This is moot, for now since, it would appear, the Tracker has gone back in hiding.
